Summary  Resumen

The work is based on the description and analysis of the crime of Ramón Ignacio González, 12 years old, which occurred in 2006 in Mercedes. Corrientes. Argentina, for which ten people who formed a sectarian group were convicted and whose motive was the sacrifice and offering of the child.
El trabajo parte de la descripción y el análisis del crimen de Ramón Ignacio González de 12 años, ocurrido en 2006 en Mercedes. Corrientes. Argentina por el cual resultaron condenadas diez personas que formaban un grupo sectario y cuyo móvil fue el sacrificio y ofrenda del niño.
From this analytical description we intend to extract particular and distinctive characteristics of ritual crime.
A partir de esta descripción analítica se pretende extraer características particulares y distintivas del crimen ritual.

Abstract

The work is based on description and analysis of the crime of Ramón Ignacio González, 12 years old, happened in 2006 in Mercedes. Corrientes. Argentina for which ten people who formed a sectarian group were convicted and whose motive was the sacrifice and offering of the child.

From this analytical description it is intended to extract particular and distinctive characteristics from ritual crime.

Conceptual Framework  1. Marco Conceptual

For this paper we will use the concept of ritual crime unifying the meanings of the terms that compose it: The Royal Spanish Academy (RAE) defines crime as a serious offense in its first meaning.

Ossorio (1994) takes this definition, but warns that, in the Argentine Penal Code, under the generic denomination of crime, all classes and categories of punishable offenses are included, except misdemeanors and contraventions, unlike other penal codes that adopt the classification of crimes, misdemeanors and contraventions.

He also cites Soler, who points out the convenience of a bipartite doctrinal classification, in which the crime includes the most serious infractions, punishable with penalties of more than five years of imprisonment, and the offense remains for the remaining infractions of the law that carry penalties of less than five years of imprisonment and more than six days of deprivation of liberty.

On the other hand, the term ritual derives from rito, from the Latin ritus, custom, ceremony (Gomez de Silva, 1988).

In its common meaning it is the act, generally religious, in accordance with prescribed rules, a custom or act repeated in an invariable manner.

In the anthropological sense, it is the repetitive act or ceremony aimed at directing a supernatural force to an end (Hunter and Whitten, 1981 a).
 En sentido antropológico es el acto o ceremonia repetitiva que tiene por objeto orientar una fuerza sobrenatural hacia un fin (Hunter y Whitten, 1981 a).
Ritual or ritual is defined by Winick (1969) as the sequence or series of acts, usually of a religious or magical nature, imposed by tradition.
El ritual o el rito es definido por Winick (1969) como la secuencia o serie de actos por lo general de corte religioso o mágico, impuestos por la tradición.
In all societies there are ideas and beliefs about man, nature and the relationships that are interwoven between people and between people and the surrounding world, both the artificial, man-made and the natural world.
En todas las sociedades se encuentran ideas y creencias acerca del hombre, la naturaleza y las relaciones que se entretejen entre las personas y entre estos y el mundo que los rodea tanto el artificial, creado por el hombre como el mundo natural.
Some of these ideational representations reflect an empirical knowledge of natural and sociocultural reality; others, on the other hand, manifest an illusory and imaginary knowledge of it.
Parte de estas representaciones ideacionales reflejan un conocimiento empírico de la realidad natural y sociocultural; otras en cambio, manifiestan un conocimiento ilusorio e imaginario de la misma.
However, both have a practical-social effect, since they are used to intervene, either to modify or maintain, the socio-cultural reality that surrounds them.
 No obstante, ambas tienen un efecto práctico-social, dado que son utilizadas para intervenir, sea para modificar o mantener, la realidad sociocultural que los rodea.
Ritual is religion in action. The basic objective of all rituals is to mobilize supernatural beings and powers for the purpose of achieving or preventing certain transformations from occurring in man or nature (Salvat, 1973).
El ritual es la religión en acción. El objetivo básico de todos los rituales es movilizar a los seres y poderes sobrenaturales con el propósito de lograr o prevenir que ocurran ciertas transformaciones en el hombre o en la naturaleza (Salvat, 1973).
It can be seen from this concept that, by its very nature, ritual crime transcends the well-known crime-offender-penalty trinomial. For this reason, it is useful for the proposed purposes to adopt the approach that various authors call the "criminal question".
Puede avizorarse desde este concepto que, por su propia naturaleza, el crimen ritual trasciende al conocido trinomio delito-delincuente-pena. Por ello, resulta útil a los fines propuestos adoptar el enfoque que diversos autores denominan como "cuestión criminal".
This concept emerged in the 1970s in the Italian context, as an alternative to the classic view that began and ended with the crime and/or the offender.
Este concepto surgió en la década de 1970 en el contexto italiano, como alternativa a la mirada clásica que empezaba y terminaba en el delito y/o el delincuente.
Tamar Pitch (2003) points out that the criminal question means considering criminality in its interaction with the procedures that define it, the tools of administration and control, penal policies and the debates that are generated around it.

It tentatively defines it, in its own terms, as "an area constituted by actions, political institutions and discourses whose boundaries are mobile".

Sozzo (2009) considers in this regard that problematizing crime by approaching it as a social and political construction does not detract from its reality, and he notes that within the framework of this approach, "singular or complex" acts that have negative consequences for the life, integrity and values of human groups cannot be ignored.

The aforementioned author makes reference to the fact that Criminal Law and specifically Criminal Law are artifices also derived from a social and political construction.

We can add that this situation does not detract from its importance either; but when dealing with a type of crime that is not typified in the Penal Code that governs us and that appears, even in isolated cases, as an emerging phenomenon, it is inevitable to also problematize this absence without this necessarily resulting in a careless simplification that yields as an obvious result a new typification added to the Penal Code.
 Podemos agregar a ello que esta situación tampoco le quita entidad; pero cuando se aborda un tipo de crimen que no se encuentra tipificado en el Código Penal que nos rige y que se presenta, aún en casos aislados como un fenómeno emergente, es inevitable problematizar también esta ausencia sin que ello redunde necesariamente en una simplificación descuidada que arroje como resultado obvio una nueva tipificación agregada al Código Penal.
Problematizing this aspect means that, within the framework of a conjunction of theories, all the issues involved are identified and methodological aspects are taken into account in their treatment.

Anitua (2005) states that there is a "necessary transdisciplinarity of thought" on what is called the criminal issue, which he considers "a very heterogeneous set of objects of study, contributed by different thoughts" referring to criminological thoughts (p.

The transdisciplinarity mentioned by this author occurs when "an integrated complex of academic disciplines concur on the object "criminal issue" and "create a new discourse that selects and organizes results from other academic disciplines".

Thus, in this case, criminal investigation (judicial and police) was complementary to anthropological research in two specific disciplines: Ethnography and Biological Anthropology.
Es así que para el caso que nos ocupa la investigación penal (judicial y policial) se dio complementariamente a la Investigación antropológica en dos vertientes disciplinarias específicas: la Etnografía y la Antropología Biológica.
As we know Anthropology as a science is the study of human beings in their biological and socio-cultural aspects from pre-human to present humanity in specific times and places.
Como sabemos la Antropología como ciencia es el estudio del ser humano en sus aspectos biológicos y socioculturales desde los pre humanos hasta la humanidad actual en tiempos y lugares concretos.
Rossi and O'Higgins (1981 a) define anthropology as "the systematic and comparative study of the variants of human groups, considering both their physical and cultural characteristics" (p.13).

Every anthropological study is, by definition, comparative and holistic: a part cannot be understood without the whole. Anthropologists consider each culture as one among several alternative ways of life (1981 b).

Its two main branches are cultural anthropology and biological anthropology. The latter encompasses the development of knowledge concerning the biological, physical and genetic characteristics of both ancient and modern human populations.

Meanwhile, cultural anthropology is interested in learned behavior in human societies. Hoebel (1985 a).

Within this branch as a sub-discipline is Ethnography from the Greek ethnos (people) and graphein (to write) which is defined as "the descriptive study of human societies" (Hoebel, 1985 b, p. 12).
 Dentro de esta rama como una subdisciplina se halla la Etnografía del griego ethnos (pueblo) y graphein (escribir) que se define como "el estudio descriptivo de las sociedades humanas" (Hoebel, 1985 b, p. 12).
Since the 19th century, ethnographic research has been carried out in the field to directly study human societies.
 Desde el siglo XIX las investigaciones etnográficas se realizan en el terreno para estudiar directamente las sociedades humanas.
The New Ethnography proposed a new approach that provides greater rigor to the results of fieldwork by aiming to discover and describe the meanings in force among the members of the human group under study.
La Nueva Etnografía propuso un nuevo enfoque que brinda mayor rigurosidad a los resultados de los trabajos de campo al proponerse descubrir y describir los significados en vigencia entre los miembros del grupo humano estudiado.
The descriptions obtained are called emic statements. Likewise, cognitive anthropology linked it simultaneously with psychology and linguistics.

Anthropologists no longer confine themselves to the study of small primitive societies; the same research approaches, methods and strategies are frequently employed in the study of communities, institutions or other human groupings (Hunter et al, 1981 b).

In 1980 the author of this paper, in the context of ethnographic fieldwork on magical, mythical and religious aspects in marginal urban and rural areas of Corrientes, had his first contacts with alleged acts of human sacrifice that could not be confirmed.

A ritual crime of an Umbandist practitioner that had occurred in the city of Resistencia, Chaco in the mid-1970s was the first firm incursion into this type of crime, even though it was studied in the years after it was committed.

These experiences were the foundation for the creation of a line of study and research called Ethnography of Ritual Crime.
Estas experiencias constituyeron los cimientos para crear una línea de estudio e investigación denominada Etnografía del Crimen Ritual.
The anthropological approach through one of its disciplines on a serious crime, such as the Ethnography of Crime, allows to know the human behavior, modeled by the culture of a current community, which when distorted by its members or members outside it, with antisocial purposes, produces imbalance in interpersonal relationships and links, as well as other concurrent crimes that reach homicide, for which it is required to systematically understand the causality of the facts with useful purpose to the judicial work.
El enfoque antropológico a través de una de sus disciplinas sobre un delito grave, como es la Etnografía del Crimen, permite conocer la conducta humana, modelada por la cultura de una comunidad actual, que al ser esta distorsionada por parte de sus miembros o miembros ajenos a ella, con propósitos antisociales, produce desequilibrio en las relaciones y vínculos interpersonales, como así también otros delitos concurrentes que llegan al homicidio, para lo cual se requiere comprender sistemáticamente la causal de los hechos con finalidad útil a la labor judicial.
It is for this last purpose that the Ethnography of Crime is epistemologically located in the field of Forensic Anthropology (Miceli, 2009).

Ethnographic research applied to the field of crime, whether it is carried out individually or in groups, implies having in-depth knowledge of those cultural patterns that, distorted from their traditional context, are oriented and tend to individual actions or the formation of organizations that often damage protected legal assets as a result of behaviors that deviate from those that regulate the global social group by consensus.
La investigación etnográfica aplicada al campo del delito sea este realizado en forma individual o grupal, implica disponer de conocimientos profundos sobre aquellas pautas culturales que, distorsionadas de su contexto tradicional, se orientan y propenden a acciones individuales o a la formación de organizaciones que muchas veces dañan bienes jurídicos protegidos a raíz de conductas desviadas de aquellas que norman consensuadamente al grupo social global.

The descriptive and analytical-interpretative study of the components of contemporary material and immaterial culture, which, interrelated as a system, intervene as a factual and/or symbolic foundation in the consummation of a serious crime at the individual or collective level in specific areas.
El estudio descriptivo y analítico-interpretativo de los componentes de la cultura material e inmaterial contemporánea, que, interrelacionadas como un sistema, intervienen como fundamento factual y/o simbólico en la consumación de un delito grave a nivel individual o colectivo en ámbitos específicos.

The province of Corrientes is located in the northeast of Argentina and has a tripartite international border: Paraguay to the north, Brazil to the east and Uruguay to the southeast.
La provincia de Corrientes está ubicada en el nordeste de la Argentina y posee una frontera internacional tripartita: al Norte Paraguay, al Este Brasil y al Sudeste Uruguay.
The territory has an area of and a population of 994,000 inhabitants (2010 census). Its approximate population composition is of Creole roots in a , mestizo in a , descendants of European immigrants and others, in a , descendants of blacks and mulattoes (very mixed) in a and aborigines (Guarani and others) in a . In pre-Columbian times, the current provincial territory was populated by different aboriginal groups, being the Guarani the last to settle. This was one of the ethnic groups with which the Spanish conquistadors made contact (Rodríguez, 2001).
En tiempos precolombinos el actual territorio provincial, estuvo poblado por diferentes grupos aborígenes, siendo los guaraníes los últimos en asentarse. Esta fue una de las etnias con las que toma contacto el conquistador español (Rodríguez, 2001).
The predominant religion up to the present is Roman Catholic, although the roots of the belief system (sacred and profane) are the result of the fusion of the Catholic faith, with beliefs of Guarani origin and cults of black and mulatto descendants, which later, since the middle of the century , grew even more, due to the contacts and mixture of cults of Afro-Brazilian origin (Miceli, 1997).

As will be seen below, the incidence of poverty in the case in question is not so much reflected in the culprits, who constitute a very heterogeneous group in socioeconomic terms and educational levels, as in the choice of victim.

2.1. Contemporary Sociocultural Context of the Supernatural

The foundations of the mysticism of the native population of the province of Corrientes, whether rural or urban, are based on the mythical and magical beliefs of the Guarani ethnic group and, after the Spanish conquest, they will be absorbed mainly by the Jesuit Reductional Missions, not only as productive labor but also as catechumens (Miceli, 2016).
Los cimientos ideacionales de la mística de la población nativa de la provincia de Corrientes, sea su locación rural o urbana, se fundan sobre las creencias míticas y mágicas de la etnia guaraní y a partir de la conquista española, estos serán absorbidos principalmente por las Misiones Reduccionales Jesúticas, no solo como mano de obra productiva sino como catecúmenos (Miceli, 2016).
Thus, from the 17th century onwards, the linking of magical and religious principles, based on the strength and power of nature, amalgamated in a God, in the cult of the dead, together with ideas of spells and enchantments and the integration of a new element: the images representing the deities.
 Se produce así a partir del siglo XVII, el enlace de principios mágicos y religiosos, sustentados en la fuerza y poder de la naturaleza, amalgamados en un Dios, en el culto a los muertos, juntamente con ideas de maleficios y encantamientos y con la integración de un elemento nuevo: las imágenes que representan a las deidades.
Of great importance has been the integral aboriginal contribution to the current society, where aboriginal material and immaterial aspects are observed in the contemporary Creole culture, being intertwined in the thought and ideologies of the settlers (urban and rural), to such a degree that when referring to the evil spell or enchantment, which is vernacularly called payé, they do it with fear.
De gran importancia ha sido el aporte integral aborigen a la sociedad actual, donde se observan aspectos materiales e inmateriales aborígenes en la cultura criolla contemporánea, hallándose entrelazados en el pensamiento e ideologías de los pobladores (urbanos y rurales), en un grado tal que al referirse al maleficio o encantamiento al que vernáculamente se lo denomina payé, lo hacen con temor.
The term payé is a symbolized derivation, which expresses a state of magical evil enchantment and was the term used to refer to the Guaraní shaman of yesteryear (Miceli, 1993).
 El término payé es una derivación simbolizada, que expresa un estado de encantamiento maléfico mágico y era el término usado para denominar al chamán guaraní de antaño. (Miceli, 1993).

In Corrientes, Afro-Brazilian religions were assimilated with Hispanic-Guarani magical and religious aspects such as the payé, as well as with a particular medieval representation of Death that today is part of a local cult called Señor La Muerte, some call it San La Muerte indistinctly but they are different representations since the San La Muerte has its origin in Christ after being scourged on the column, iconographically he is represented sitting with his hands on his chin or on his knees.

One of the characteristics of Lord Death is that symbolically it is nourished by the blood of its possessor, when coupled with Afro-Brazilian practices where blood sacrifices and animal blood baths are actually performed, the symbolism is replaced by actual acts of blood offerings (Neto et al., 2009).

It was in this city where the case analyzed here took place. The victim Ramón Ignacio González (a) Moná (a) Ramoncito, 12 years old, was one more child among those who suffer abandonment and social indifference.

All this is governed by a magical-religious worldview, not exempt from material and power ambitions, whose cosmogony is integrated with other deities to serve and worship. These characteristics sustain the ideology of a sect.

In the magical-religious conception of its officiants, this means that the soul of the corpse was found at the intersection of a road and a street at the access to the village.

In this case they were left out of the judicial and police arc: The people who commissioned this ritual, the healers who performed abortions and sold fetuses for the rituals, the occasional participants in orgiastic rituals with minors, the mothers who prostituted their children, the manufacture of drugs and drug dealing, the child and juvenile pornography businesses, among several other concurrent and integral crimes that maintained the brotherhood of the practitioners and ensured a source of income that not only financed the requirements of the group without which it would not have been able to function over time, but also strengthened the cohesion of its members.
En este caso quedaron fuera del arco judicial y policial: Las personas que encargaron este ritual, las curanderas que practicaban abortos y vendían fetos para los rituales, los participantes ocasionales en rituales orgiásticos con menores, las madres que prostituían a sus hijos, la fabricación de drogas y narcomenudeo, los negocios de pornografía infantojuvenil, entre otros varios delitos concurrentes e integrales que mantenían la hermandad de los practicantes y aseguraba una fuente de ingresos que no solo financiaba los requerimientos del grupo sin los cuales no hubiese podido funcionar en el tiempo, sino que además afianzaba la cohesión de sus miembros.
It goes without saying that an exhaustive study of the legislation is necessary, as well as the training of police and justice personnel to deal with crimes of this complexity.
