Notice on the Issuance of the "Management Regulations for Production Safety Accidents of China Railway Fourth Survey and Design Institute Group Co., Ltd."
The "Production Safety Accident Management Regulations of China Railway Fourth Survey and Design Institute Group Co., Ltd." have been approved by the 7th Director's Office Meeting of the Group Company in 2022 and are now issued for implementation. Please comply with them.
Regulations on Production Safety Accident Management of China Railway Fourth Survey and Design Institute Group Co., Ltd
Chapter One: General Principles
Article 1 In order to standardize the management of production safety accidents, prevent and reduce production safety accidents, and in accordance with national and relevant departmental regulations, based on the "Regulations on the Management of Production Safety Accidents of China Railway Construction Corporation Limited" (China Railway Construction Safety Supervision [2020] No. 111) and other documents, this regulation is formulated in conjunction with the actual situation of the group company.
Article 2: A production safety accident refers to an incident that occurs during production and business activities, resulting in personal injury or direct economic loss. Production and business activities refer to activities conducted during working hours and in the workplace to achieve certain production, construction, or business objectives, including preparatory or concluding activities related to work. Production safety accidents include: production accidents (including those caused by survey design or construction quality), fire accidents, railway traffic accidents, and road traffic accidents.
Article 3 These regulations apply to units, project departments, and subsidiaries affiliated with the group company (hereinafter collectively referred to as "units").
Article 4 According to the "Regulations on the Reporting and Investigation of Production Safety Accidents" (State Council Order No. 493), accidents are classified into four levels: particularly major accidents, major accidents, larger accidents, and general accidents.
The group company implements "zero accidents" target management for all units.
Chapter Two: Accident Report
Article 5: The following incidents must be reported:
(1) A general or higher-level production safety accident occurs;
(2) Situations where personnel are in danger, trapped, or missing;
Accidents caused by natural disasters.
Article 6 The accident report shall meet the following requirements:
(1) Report step by step
After the accident occurs, relevant personnel at the accident site should immediately report to the site manager. Upon receiving the accident report, the site manager should promptly report to the next higher-level unit manager and continue to report up to the group company.
For accidents occurring within the territory, the accident unit should report to the emergency management department of the county-level or higher people's government and the relevant departments responsible for safety production supervision and management within 1 hour; for accidents occurring outside the territory, the overseas institution should immediately report to the embassy or consulate in the host country (region).
(2) Accident reports can be made via telephone, messaging, fax, etc. The reporting time for each level must not exceed 1 hour, and additional reports can be made at any time based on the emergency response situation.
In emergency situations, relevant personnel at the accident site can directly report to the group company, the emergency management department of the county-level or higher people's government where the accident occurred, and the relevant departments responsible for safety production supervision and management.
Article 7 The report of the accident shall include the following content:
(1) Unit where the accident occurred;
(2) The time, place, and circumstances of the accident;
(3) A brief account of the accident;
The number of casualties (including missing persons) that have already occurred or may occur due to the accident, as well as the social impact caused
(5) Measures that have already been taken;
(6) The situation reported to relevant units and administrative authorities;
(7) Other situations that should be reported.
Article 8: After each unit receives an accident report, it should promptly fill out the "Production Safety Accident Quick Report Form" (see Attachment 1) and report it to the Group Company's Safety and Quality Management Department. Within 24 hours of the accident, the report should include the details of the incident, rescue situation, number of casualties already caused or potentially caused, measures taken, and preliminary causes of the accident.
Article 9: If new circumstances arise after the accident report, a supplementary report should be submitted promptly.
Within 30 days from the date of the accident, if there is a change in the number of casualties caused by the accident, it should be reported promptly. For fire accidents and road traffic accidents, if there is a change in the number of casualties within 7 days from the occurrence, it should be reported promptly.
Article 10 Each unit shall annually compile statistics on production safety accidents that occurred within the unit and complete the "Annual Report on Production Safety Accidents" (see Attachment 2), which must be submitted to the Safety and Quality Management Department of the group company by January 5 of the following year. The production safety accident statistical report implements a zero-reporting system.
Article 11: Any unit or individual must report safety incidents in a timely and accurate manner as required, and must not delay, omit, falsely report, or conceal such reports.
Chapter Three: Accident Investigation
Article 12 After an accident occurs, the accident unit shall properly protect the accident scene
And related evidence, no unit or individual may destroy the accident scene or eliminate relevant evidence. If it is necessary to move objects at the scene for reasons such as rescuing personnel, preventing the accident from worsening, or alleviating traffic, they should mark the site, draw a simple map of the scene, take photographs, and write a written record, while properly preserving important traces and physical evidence at the scene.
Article 13 The accident unit shall actively cooperate with the investigation team's lawful investigation work, shall not obstruct or interfere, and shall not conceal, fabricate, or destroy relevant evidence.
Article 14: Upon receiving the accident report, the superior unit where the accident occurred shall establish an accident investigation team to conduct an internal investigation. The internal investigation primarily aims to identify issues related to management, technology, equipment, etc., summarize the lessons learned from the accident, and propose preventive and corrective measures. The format for the internal investigation report is detailed in Attachment 3.
The group company cooperates with the joint-stock company in the internal investigation of major and above production safety accidents
(2) The group company organizes internal investigations of general production safety accidents;
(3) For personnel injuries and engineering hazards that do not constitute a graded accident, the accident unit shall organize an internal investigation.
Article 15 After the accident case is closed, the accident unit shall promptly report the government's accident investigation report and the internal investigation situation to the Safety and Quality Management Department of the group company.
Chapter Four: Punishment, Handling, and Accountability
Article 16: Adhere to the principles of "shared responsibility between the Party and government, dual responsibility for one position, joint management, and accountability for negligence." Based on the government-approved investigation report on production safety accidents, corresponding safety production job responsibilities shall be assigned, and relevant responsible persons shall be handled at different levels according to the authority of cadre management.
Article 17 Economic Penalties for Responsible Units in Accidents
Due to the occurrence of general production safety responsibility accidents, the group company will impose economic penalties on the responsible units, with fines executed according to the standards of the joint-stock company; in the case of significant or more serious production safety responsibility accidents, the joint-stock company will impose economic penalties on the group company, and the fines will be borne by the responsible units.
The penalty standards for joint-stock companies are as follows:
(Punishment Standards)
For production safety accidents that cause casualties and for which the unit is primarily responsible, a fine of 4 million yuan will be imposed for each death, 2 million yuan for each serious injury, and 1 million yuan for each minor injury. For production safety accidents that cause casualties but for which the unit is not primarily responsible, the fines will be halved according to the above standards.
For incidents that did not result in casualties, they are classified as production safety responsibility accidents, and a fine of will be imposed based on the direct economic losses incurred.
Additional Fines
For each major production safety accident with significant responsibility, an additional fine of 30 million yuan will be imposed
For each major production safety responsibility accident that occurs, an additional fine of 100 million yuan will be imposed
For each occurrence of a particularly serious production safety accident, an additional fine of 300 million yuan will be imposed.
(3) Project under the name of a joint-stock company
For the relevant units responsible for investment development, construction management, and general contracting, an economic penalty will be imposed according to the penalty limit of the construction unit of
For responsible design, supervision, and other units, an economic penalty will be imposed according to the penalty limit of the construction unit at .
Article 18: Depending on the level of the accident, the degree of responsibility, and the extent of the impact, measures may be taken
Accidents are handled through one or more methods such as notifications, interviews, economic penalties, and administrative sanctions, along with targeted warning education.
Article 19 The group company shall report the accident situation through warning meetings, notifications, and other forms.
Article 20: The group company shall impose economic penalties on the primary responsible person for production safety in the event of a production safety accident, in accordance with the "Implementation Measures for the Safety Work Responsibility System of China Railway Fourth Survey and Design Institute Group Co., Ltd." (Document No. 72 [2022] of the Fourth Institute of Safety and Quality) and the "Annual Safety Work Responsibility Letter."
Article 21 Administrative Sanctions and Organizational Measures
In the event of production safety responsibility accidents, major hazardous incidents, or violations of safety production regulations, accountability will be pursued in accordance with the relevant provisions of the "Disciplinary Regulations for Employees of China Railway Construction Corporation Limited and China Railway Construction Corporation" (Zhongtie Jianjian [2018] No. 17) and the "Implementation Measures for Employee Rewards and Punishments of China Railway Fourth Survey and Design Institute Group Co., Ltd." (Siyuan Ren [2017] No. 144).
Article 22: If the personnel responsible for production safety accidents are party members, they shall be subject to disciplinary action in accordance with the "Regulations on Disciplinary Actions of the Communist Party of China" and the "Implementation Measures (Trial) for the Enforcement of the 'Regulations on Accountability of the Communist Party of China' by the Party Committee of China Railway Construction Corporation and the Party Committee of China Railway Construction Co., Ltd." (Zhongtie Jian Party Discipline [2018] No. 14), based on the level of the accident and the responsibility involved. Disciplinary actions shall be specifically implemented by the discipline inspection commissions at all levels according to the management authority of cadres, while accountability (excluding disciplinary actions) shall be specifically implemented by the functional departments of the party committees at all levels according to organizational authority and work procedures, with relevant departments providing assistance.
Article 23: In the event of a production safety accident that violates criminal law, it shall be referred to the judicial authorities for handling.
Chapter Five: Accident Assessment
Article 24: The management of production safety accidents in each unit is included in the annual performance assessment of the group company.
Article 25: Late reporting, missed reporting, false reporting, or concealment of reporting will result in increased deductions in performance evaluation points based on the circumstances.
Chapter Six: Supplementary Provisions
Article 26 The interpretation of these regulations is the responsibility of the Safety and Quality Management Department of the Group Company.
Article 27 These regulations shall come into effect on January 1, 2022.
